Module 9 · Compliance, HIPAA & Billing Ethics
Lesson 3 of 5

Fraud, Waste and Abuse in Medical Billing

Billing compliance requires accurate claims that reflect the services actually furnished and the applicable coverage and coding rules. Errors must be corrected; knowingly false billing can create serious legal and financial exposure.

Accurate claims are the foundation

OIG guidance emphasizes that claims submitted to Federal health care programs should be true and accurate. Billing teams should never alter codes, dates, provider information or documentation merely to make a claim pay.

Common risk examples

RiskWhat it can look like
UpcodingReporting a higher-paying level or service than the documentation supports.
UnbundlingBilling components separately when rules require them to be included together.
Services not renderedSubmitting a claim for a service that did not occur.
Medical-necessity issuesBilling services that do not meet the payer/program requirements for coverage or documentation.
Provider eligibility issuesBilling under a provider or arrangement that does not satisfy applicable participation, supervision or exclusion rules.

Error versus misconduct

Not every coding or billing mistake is fraud. Intent, knowledge and the surrounding facts matter. From an operational perspective, staff should report errors promptly, preserve documentation and use the organization's correction process instead of hiding or repeating the issue.

Never “code to payment.” If documentation does not support a code, modifier or service, do not add it simply because a payer denied the claim.

Quick knowledge check

What is upcoding?

Using a billing code that represents a more intensive or expensive service than was supported or provided.

Is every billing error fraud?

No. But errors still require correction and recurring patterns should be investigated.

What should you do if a supervisor asks you to use a code you believe is unsupported?

Do not guess or conceal the concern; follow the organization's compliance escalation process.
