Module 9 · Compliance, HIPAA & Billing Ethics
Lesson 2 of 5

Minimum Necessary and Secure Communication

The minimum necessary standard is one of the most practical HIPAA concepts for billing operations. It asks covered entities to make reasonable efforts to limit many uses, disclosures and requests for PHI to what is needed for the intended purpose.

Minimum necessary

HHS states that covered entities generally must make reasonable efforts to limit many uses, disclosures and requests for PHI to the minimum necessary to accomplish the intended purpose. Policies should also restrict workforce access based on job roles.

Important limits and exceptions

The minimum necessary standard does not apply in every HIPAA situation. For example, HHS identifies disclosures to or requests by a health care provider for treatment as an exception. Billing staff should rely on organizational policy rather than trying to apply legal exceptions independently.

Secure communication habits

Email and messaging

Use approved secure systems. Confirm the recipient before sending PHI and avoid unnecessary identifiers.

Phone calls

Verify identity according to policy before discussing account details, and avoid being overheard in public areas.

Workstations

Lock screens, use individual credentials and keep printed PHI controlled and disposed of through approved methods.

Common avoidable mistakes

  • Sending PHI to the wrong email address.
  • Attaching an entire chart when only a narrow document is needed.
  • Leaving patient information visible on an unattended screen.
  • Discussing identifiable patient details where others can hear.
  • Copying PHI into unapproved personal apps or devices.

Quick knowledge check

Does minimum necessary mean “use absolutely no extra information under any circumstance”?

No. HHS describes it as a reasonableness standard applied through organizational policies and procedures.

Should you use a personal messaging app for PHI because it is faster?

No. Use approved systems and policy.

What is a simple privacy check before sending a message?

Confirm the recipient, purpose and amount of PHI included.
